Terms of Service

1. Definitions

In these Terms:

• Service: the online booking system FlexBookz.
• User: any individual or entity registered for the Service.
• Subscription: the chosen paid package.
• Agreement: the contract between FlexBookz and the User regarding the Service.

2. Applicability

These Terms apply to all use of the Service and all agreements between FlexBookz and the User. Deviations are valid only if agreed in writing.

3. Service description

FlexBookz provides an online booking system for service-based businesses such as hairdressers, nail salons, barbershops, fitness, and wellness. FlexBookz reserves the right to modify, add, or remove features of the Service.

4. Registration and contract

The User creates an account, selects a package, and completes payment. The Agreement takes effect upon registration confirmation. The User is responsible for safeguarding login credentials and for all activities under their account.

5. Subscriptions, trial, and payment

• Payment can be made via iDEAL, SEPA direct debit, PayPal, credit card, or bank transfer (processed by Stripe where applicable).
• The Flex Pro package includes a 30 days trial period.
• Cancellation is possible at any time without notice.
• Fees paid will be fully refunded if the User requests a refund within 30 days of the first payment.

6. Use and prohibited use

The User may not use the Service for:

• Illegal activities
• Sending spam
• Storing or distributing unlawful content

FlexBookz may suspend or terminate accounts in case of misuse.

7. Intellectual property

All rights to the software, code, designs, logos, trademarks, and texts of FlexBookz belong to FlexBookz or its licensors. The User receives a non-exclusive, non-transferable right to use the Service solely for its intended purpose.

8. Availability and maintenance

FlexBookz strives for high availability but does not guarantee uninterrupted operation. Maintenance may occur without prior notice unless reasonably possible.

9. Liability

• FlexBookz is not liable for indirect damages, loss of profits, data loss, or business interruption.
• Maximum liability is limited to the amount paid by the User to FlexBookz in the last 12 months.

10. Force majeure

FlexBookz is not obligated to fulfill its obligations in cases of force majeure, including third-party failures, internet outages, hacking, or government actions.

11. Changes to the Terms

FlexBookz may amend these Terms. Changes will be announced at least 30 days in advance by email. Continued use after the effective date constitutes acceptance of the new Terms.

12. Governing law and disputes

Dutch law applies. Disputes will be submitted to the District Court of Overijssel, location Zwolle.
